NEW YORK — Pfizer Inc. has sued the American Heart Association and other companies that have marketed it for years as a cost-cutting tool.
The lawsuit, filed Tuesday in New York federal court, claims that the company had to pay out $6.6 billion over six years to settle an anti-heart condition lawsuit filed by the American Heart Association.
The complaint contends that the American Heart Association, which has more than 25,000 members, has been paying out more than $7.1 billion to settle lawsuits that claim Pfizer was illegally marketing Viagra to people suffering from heart disease.
It contends that the American Heart Association had a right to warn patients that Viagra was a cheaper way to treat heart disease, and had no right to prescribe the drug to the millions of American adults who took it.
The suit also claims that Pfizer’s marketing of Viagra, which treats erectile dysfunction, was “unfair and deceptive” and “improper” and that its doctors were under no obligation to warn patients about the dangers of taking the drug. Pfizer claims that the drug is safe and effective when taken correctly, but it claims that it was marketed to doctors who were unaware of the risks.
The company also claims that the lawsuit is not time-barred, because the law allows a defendant to be sued for failure to warn under theNew York Timesadiq in 2009.
The suit also seeks unspecified damages and other damages related to the alleged adverse effect of Viagra on the heart and cardiovascular system, and seeks unspecified damages and unspecified damages for consumers who have suffered adverse effects.

“We hope that the new American Heart Association lawsuits, brought to light by the evidence presented in this case, will help us determine whether Pfizer is the appropriate defendant to sue,” said John J. Ralston, the association’s president.
The lawsuit was filed Tuesday by the National Heart Foundation and by the National Institute of Diabetes and Stroke and the National Institute on Aging.
The lawsuit is part of a larger effort to investigate the cost-cutting strategies of pharmaceutical companies.
“This case is unique from other cases in which federal judges have not held Pfizer to an appropriate standard of care,” said Matthew E. Schondelmeyer, a lawyer who represented plaintiffs in a class action filed in Philadelphia.
“The lawsuit is unique because it is based on a scientific principle of cost-effectiveness that states that drugs and other products have no risk-benefit effect on the consumer,” said Eric S. Smith, vice president of research at the National Institute on Health Care & Research.
“The United States has an obligation to the public to obtain and consume safe and effective drugs without harm.”

Men with severe heart problems, those at high risk of heart problems, liver failure, kidney failure, strokes or those taking certain other medicines, will still need to be prescribed the drug under the supervision of a doctor.
A four-pack of the tablets will cost £19.99 and an eight-pack £34.99.
Men who buy it will be advised that they can take a 50 mg tablet an hour before having sex, but should not use more than one pill a day.
